Welcome to HappyKids Events. These Terms of Service govern your use of our children's party organization services and website. By accessing our services or booking an event with us, you agree to be bound by these terms and conditions. Please read them carefully before proceeding with any bookings or inquiries.

1. Acceptance of Terms

By using the services provided by HappyKids Events, located at 22 Pitt St, Sydney NSW 2000, Australia, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use our services. These terms apply to all visitors, users, clients, and others who access or use our services, whether you are booking an event, browsing our website, or communicating with our team.

We reserve the right to modify, update, or change these terms at any time without prior notice. Any changes will be effective immediately upon posting on our website. Your continued use of our services after such modifications constitutes your acceptance of the updated terms. We encourage you to review this page periodically to stay informed about any changes.

2. Service Description

HappyKids Events specializes in professional children's party organization services, including but not limited to themed decorations, entertainment programs, venue coordination, catering arrangements, and event management. Our services are designed to create memorable celebrations for children of all ages through creative planning and execution.

2.1 Service Offerings

• Custom themed party planning and design consultation services
• Professional decoration installation, setup, and post-event cleanup
• Entertainment coordination including performers, activities, and interactive games
• Venue selection assistance and coordination with third-party providers
• Photography and videography arrangement services
• Catering coordination and menu planning for child-friendly options
• Party favors, invitations, and thank-you card design and distribution

2.2 Service Limitations

While we strive to accommodate all client requests, certain services may be subject to availability, venue restrictions, local regulations, and safety considerations. We reserve the right to decline requests that we deem unsafe, impractical, or beyond our operational capacity. All services are subject to our professional assessment and final approval.

3. Booking and Reservations

All event bookings require a completed booking form, signed service agreement, and payment of the initial deposit. Bookings are confirmed only upon receipt of the deposit payment and written confirmation from HappyKids Events. Event dates are reserved on a first-come, first-served basis and are not guaranteed until full confirmation is received.

3.1 Deposit Requirements

A non-refundable deposit of 30% of the total event cost is required to secure your booking. This deposit must be paid within 48 hours of receiving our quote to hold your preferred date. The remaining balance is due no later than 14 days before the scheduled event date. Failure to pay the balance on time may result in cancellation of your booking.

3.2 Event Changes

Requests to modify event details, including date changes, guest count adjustments, theme modifications, or service additions, must be submitted in writing at least 21 days before the event. Changes requested within 21 days of the event may incur additional fees and are subject to availability. Significant changes may require a new quote and additional deposit.

4. Payment Terms

4.1 Payment Schedule

• Initial deposit: 30% due upon booking confirmation
• Second payment: 40% due 30 days before event date
• Final payment: 30% due 14 days before event date
• Any additional services or upgrades must be paid for within 7 days of approval

4.2 Late Payment Fees

Payments not received by the due date will incur a late fee of 5% of the outstanding amount for each week overdue. If payment remains outstanding 7 days before the event, we reserve the right to cancel the booking without refund of deposits paid. Late payments may also affect service delivery and vendor commitments.

5. Cancellation and Refund Policy

We understand that circumstances change, and cancellations may be necessary. However, cancellations affect our business operations, vendor commitments, and scheduling. The following cancellation terms apply to all bookings:

5.1 Client Cancellations

• More than 60 days before event: Full refund minus initial deposit (30%)
• 30-60 days before event: 50% refund of total amount paid
• 14-30 days before event: 25% refund of total amount paid
• Less than 14 days before event: No refund provided

5.2 HappyKids Events Cancellations

In the unlikely event that we must cancel your event due to circumstances beyond our control (extreme weather, medical emergencies, force majeure), we will provide a full refund of all payments received or offer to reschedule your event at no additional cost. We are not liable for any consequential damages, travel expenses, or other costs incurred as a result of such cancellations.

6. Client Responsibilities

As a client, you agree to fulfill certain responsibilities to ensure the successful execution of your event:

• Provide accurate information regarding venue access, restrictions, and contact details
• Obtain all necessary permissions and permits for venue use and activities
• Ensure adult supervision is present throughout the event duration
• Inform us of any children with special needs, allergies, or medical conditions
• Provide final guest count confirmation at least 7 days before the event
• Ensure venue is accessible to our team at agreed setup times
• Communicate any venue rules, restrictions, or requirements in advance
• Arrange appropriate insurance coverage if required by venue or local regulations

7. Liability and Insurance

HappyKids Events maintains comprehensive public liability insurance covering our services and equipment. However, our liability is limited to the total amount paid for services rendered. We are not responsible for injuries, accidents, or damages that occur due to client negligence, venue conditions beyond our control, or actions of event attendees.

7.1 Limitation of Liability

Our maximum liability under any circumstances shall not exceed the total value of your event booking. We are not liable for indirect, consequential, or special damages including but not limited to loss of enjoyment, emotional distress, or travel expenses. Clients are encouraged to maintain their own event insurance coverage for comprehensive protection.

7.2 Indemnification

You agree to indemnify and hold harmless HappyKids Events, its employees, contractors, and partners from any claims, damages, losses, or expenses arising from your event, including claims made by attendees, vendors, or third parties related to the event activities or venue conditions.

8. Privacy and Data Protection

We respect your privacy and handle all personal information in accordance with Australian Privacy Principles and our Privacy Policy. By using our services, you consent to the collection, use, and storage of your personal information as described in our Privacy Policy. We collect information necessary for service delivery and may use it to communicate about your event, send promotional materials, or improve our services.

We implement appropriate security measures to protect your personal information from unauthorized access, disclosure, or misuse. However, no electronic transmission is completely secure, and we cannot guarantee absolute security of your data. You have the right to access, correct, or request deletion of your personal information at any time by contacting us.

9. Intellectual Property

All content on the HappyKids Events website, including text, graphics, logos, images, designs, and concepts, is the property of HappyKids Events or its content suppliers and is protected by Australian and international copyright laws. You may not reproduce, distribute, modify, or create derivative works from our content without explicit written permission.

Event photographs and videos taken during your party may be used by HappyKids Events for marketing, promotional, and portfolio purposes unless you specifically opt-out in writing. We respect client privacy and will remove any content upon request. If you wish to use our event designs, concepts, or materials for any purpose beyond your booked event, you must obtain written permission.

10. Force Majeure

HappyKids Events shall not be held liable for failure to perform services due to circumstances beyond our reasonable control, including but not limited to natural disasters, extreme weather conditions, public health emergencies, government restrictions, labor disputes, equipment failures, or supplier failures. In such cases, we will work with you to reschedule the event or provide a full refund of payments received.

11. Dispute Resolution

Any disputes arising from these Terms of Service or our services shall first be addressed through good-faith negotiations between both parties. If resolution cannot be achieved through direct communication, disputes shall be resolved through mediation in Sydney, New South Wales, Australia, in accordance with the mediation rules of the Australian Disputes Centre.

If mediation is unsuccessful, disputes may proceed to binding arbitration or legal proceedings in the courts of New South Wales, Australia. Both parties agree to submit to the exclusive jurisdiction of these courts. Legal costs and fees shall be borne by the party deemed responsible by the mediator or court.

12. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of New South Wales, Australia, without regard to conflict of law principles. Any legal action or proceeding relating to these terms shall be brought exclusively in the courts located in Sydney, New South Wales.

If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable. If modification is not possible, the provision shall be severed from these terms, and the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms of Service, together with our Privacy Policy and any signed service agreements, constitute the entire agreement between you and HappyKids Events regarding our services. These terms supersede all prior agreements, understandings, negotiations, and discussions, whether oral or written, between the parties. No amendment or modification of these terms shall be valid unless made in writing and signed by both parties.

By booking services with HappyKids Events, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
